(v) Account Holder agrees that Platform Assets created by Workato or Users may be the same as or similar to those created by Account Holder, and that it will not assert any claim against Workato or any Users for infringement or misappropriation of any intellectual property rights to any Platform Assets independently developed by Workato or Users. Nothing herein shall limit Account Holder’s ability to assert any claim based on willful misconduct or breach of confidentiality obligations.
