“ 5.5 Government Agency Requests. As of the Effective Date of this DPA, Napkin AI (and Second Layer, Inc.) has not received any formal legal requests from any government intelligence or security agency for access to Customer Personal Data. If Napkin AI receives any such request after the Effective Date, Napkin AI shall: (a) to the extent permitted by applicable law, promptly notify the Customer; (b) use commercially reasonable efforts to redirect the relevant law enforcement or government agency to request that data directly from the Customer; and (c) provide the Customer with reasonable notice of any such demand unless legally prohibited from doing so by a court of competent jurisdiction or applicable law.”
