" Automation Anywhere may collect certain information, including personal information, automatically from visitors to its Sites and those of its subsidiaries, including the IP address, time visited, pages viewed, and related information. When you visit the Sites, open emails from Automation Anywhere, use its apps, or interact with its related tools, widgets, or plug-ins, Automation Anywhere may collect certain information by automated means, such as through cookies, web beacons, local storage, scripts, pixels, and web-server logs. The information collected in this manner may include your IP address, unique device identifier, browser characteristics, domain and other system settings, search queries, device characteristics, operating-system type, language preferences, referring URLs, actions taken on the Sites, dates and times of Site visits, metadata, and other information associated with other files stored on your device. Automation Anywhere uses Google Analytics to help analyze the traffic on the Sites. " You have the right to request to have your personal information deleted from our servers, and we will direct our service providers to do the same. However, please be aware that we may not fulfill your request for deletion if we (or our service provider(s)) are required to retain your personal information for one or more of the following categories of purposes: (i) to complete a transaction for which the personal information was collected, provide a good or service requested by you, or complete a contract between us and you; (ii) to ensure our website integrity, security, and functionality; (iii) to comply with applicable law or a legal obligation or exercise rights under the law; or (iv) to otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information."

" Internet or other electronic network activity information, including but not limited to browsing history, search history, and information regarding a consumer’s interaction with a website, application, or advertisement"

" We also collect information you choose to share with us through various, customer-engagement channels, such as voice and video calls. In such circumstances, we collect your email address, name, and any other information you might provide during the call or meeting. The legal basis for processing this personal information is our legitimate interests, namely for quality and training purposes and for tracking the progress of business deals. In some situations, Automation Anywhere may record and/or transcribe the voice or video calls we have with you. At the start of such a call, we disclose the fact that a call is being recorded and, unless we are legally required to record the call, will ask for your consent to record the call and/or offer you the option to decline the call being recorded. We may use third-party systems to record and/or transcribe calls, including Zoom and Microsoft Teams. In some cases, transcripts are generated by AI tools. We do not collect voiceprints or other biometric data from voiceprints. The call recordings will be processed for the purposes stated at the start of the call, typically for quality and training purposes, and in accordance with this Privacy Policy. We enable you to exercise your rights as a data subject under applicable law with respect to these recordings as set out in this Privacy Policy. In the event that you request a copy of the recording, Automation Anywhere may provide you a redacted copy of the recording or similarly redacted transcript of the recording, where appropriate, and as permitted under applicable law."

" We do not track users over time and across third-party websites to provide targeted advertising. Accordingly, we do not currently respond or take any action with respect to web browser "do not track" signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information about an individual consumer's online activities over time and across third-party websites or online services. However, some of our service providers and advertisers may use cookies or other methods to gather information regarding your use of the Sites and may combine the information in these cookies with any personal information about you that they may have. The use of such tracking information by a third party is subject to its privacy policy."

" Automation Anywhere may amend or modify this Privacy Policy from time to time. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by posting the amended or modified version on its website at https://www.automationanywhere.com . This Privacy Policy may also be changed, or limited, to comply with legal or regulatory requirements or as otherwise allowed or required by law."

"Except as otherwise provided in these Terms, the Content may not be copied, downloaded, or stored in a retrieval system for any other purpose, nor may it be redistributed, reused, or modified for any purpose without the express written permission of Automation Anywhere. Additionally, you agree not to: collect information from the Sites using any automated software tool or manually on a mass basis; use automated means to access the Sites, or gain unauthorized access to the Sites, or to any account or computer system connected to the Sites; obtain, or attempt to obtain, access to restricted or password protected areas of the Sites, except as authorized through your account; “flood” the Sites with requests or otherwise overburden, disrupt, or harm the Sites or our systems; take any action to restrict or inhibit other users from accessing or using the Sites; modify or delete any copyright, trademark, or other proprietary rights notices that appear on the Sites or in the Content; or access or use the Sites for any unlawful purpose or otherwise beyond the scope of the rights granted herein."

" Automation Anywhere may collect certain personal information when someone voluntarily sends a direct, mail inquiry, an email or online registration, registers to download documents from the Sites, participates in seminars or webinars, requests Company information at tradeshows, applies for a job via the Sites, requests information, or purchases goods or services, via the Sites (including via our bot store located at https://botstore.automationanywhere.com ). Examples of such personal information include, but are not limited to, individual names, telephone numbers, email addresses, company name, mailing address, account username and password, job title, and financial information (e.g., credit or debit card number). If you apply for a job via the Sites, we may also collect personal information via your resume or any cover letter you choose to upload, or via any social media profile to which you elect to provide access. We process personal information you provide us either (i) in connection with our legitimate business interests, or (ii) to the extent necessary for performance of a contract with you, your company, or our customer."

" When you register for and interact with the Sites (including but not limited to Pathfinder, Community, Agentic App Store, Agentic Quest, Automation Anywhere University, and Mission Control) for training, certification, and engaging with the community, we may automatically collect information on your IP address and any information generated by your registering and interacting with such sites, such as but not limited to usernames, levels, points earned in community, training, and the Agentic App Store, community and training badges, and forum commentary. The legal basis for processing your personal information is (i) consent (where required by law) or (ii) our legitimate interest in hosting and maintaining such a community for the benefit of its members, to develop the Pathfinder and Automation Anywhere ecosystems, to assess your skills in issuing Pathfinder certifications/credentials, and to inform you of program changes important to your participation or that relate to additional, security measures."

" When you download and use our mobile applications, we may automatically collect information on the type of device you use, operating system and version, and system and performance information. We collect this information to help us measure app usage and better understand user demographics and event attendance. With your consent, we may send you push notifications from time-to-time in order to update you about any events or promotions that we might be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. We process personal information collected via our mobile applications (i) in connection with our legitimate business interests in operating the Sites, performing the services, or operating our business, or (ii) otherwise to the extent you have agreed that we may do so."

" Account Registration and Security. Access to and use of certain areas of the Sites (including www.automationanywhereuniversity.com , https://botstore.automationanywhere.com/ , our Customer Community located at https://apeople.automationanywhere.com/ and our partner portal located at https://www.automationanywhere.com/resources/partners may require you to register for an account and set up a username and password, and may require you to agree to separate terms. You agree to provide true, accurate, current, and complete information about yourself as prompted by the applicable registration or log-in form, and you are responsible for keeping such information up to date. Your username and password are for your exclusive use only and sharing your credentials with another user or using someone else’s credentials is not permitted and may result in immediate blocking of your access to the applicable Site. You are responsible and liable for all activities conducted through your account, regardless of who conducts those activities. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to immediately notify Automation Anywhere of any unauthorized use of your account, or any other breach of security. You agree that we are not liable for any loss or damage arising from your failure to protect your username or password."

" Procedure for Claims of Intellectual Property Infringement. We respect all relevant copyright laws and ask that you do the same. We may, in appropriate circumstances and at our discretion, limit, disable, and/or terminate your access to or use of the Sites or Content if we determine you may be infringing the intellectual property rights of a third party. If you believe that your work has been copied in a way that constitutes copyright infringement or your intellectual property rights have been otherwise violated, please provide the following information to us in writing: A description of the copyrighted work claimed to have been infringed; or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; A description of the infringing material and information reasonably sufficient to permit us to locate the material; Your contact information, including your address, telephone number, and email; A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and A statement that the information in the notification is accurate and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner. " Third Party Materials. The Sites may display, include, or make available third-party content (including User-Generated Content, data, information, applications, and other products, services, and/or materials) or provide links to third-party websites or services (collectively, “Third Party Materials”). You acknowledge and agree that Automation Anywhere is not responsible for Third Party Materials including their accuracy, completeness, timeliness, validity, legality, decency, quality, or any other aspect thereof. Automation Anywhere does not assume and will not have any liability to you or any other person or entity for any Third Party Materials. Third Party Materials and links thereto are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions."

" Change and Suspension. 11.1 Disclaimer of Warranties EXCEPT AS OTHERWISE SET FORTH IN WRITING BY AUTOMATION ANYWHERE, THE SITES AND THE CONTENT ARE PROVIDED TO YOU ON AN "AS IS" "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, AND AUTOMATION ANYWHERE HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. NEITHER AUTOMATION ANYWHERE NOR ANY PERSON ASSOCIATED WITH AUTOMATION ANYWHERE MAKES ANY REPRESENTATION OR WARRANTY WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITES OR THE CONTENT. WITHOUT LIMITING THE FOREGOING, EXCEPT AS OTHERWISE SET FORTH IN WRITING BY AUTOMATION ANYWHERE. NEITHER AUTOMATION ANYWHERE NOR ANYONE ASSOCIATED WITH AUTOMATION ANYWHERE REPRESENTS OR WARRANTS THAT THE SITES OR THE CONTENT WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SITES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITES OR THE CONTENT WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS. 11.2 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL AUTOMATION ANYWHERE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITES OR THE CONTENT, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, PROFITS, OR BUSINESS, LOSS OF USE, OR LOSS OF DATA, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. " Indemnification. You agree to indemnify, defend, and hold Automation Anywhere and its officers, directors, employees, agents, licensors, and service providers harmless from and against any claims, liabilities, losses, damages, judgments, awards, costs, and expenses (including reasonable attorneys’ fees) arising out of or resulting from your use of the Sites and/or any Content, or any violation of these Terms or applicable law. Your indemnification, defense, and hold harmless obligations will survive the termination of your use of the Sites, and/or these Terms."

" Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, 34 C.F.R. Part 99). Automation Anywhere may disclose each of these categories of personal information with our service providers for our business purposes (to enable the service providers to provide their services) and as otherwise described in the “Sharing of Personal Information” section above."

" Miscellaneous. 14.1 Electronic Communications. The communications between you and Automation Anywhere via the Sites use electronic means. For contractual purposes, you consent to receive communications from us in electronic form, and you agree that all terms and conditions, agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. 14.2 Geographic Restrictions. The Sites are provided from, and Automation Anywhere is based in, the state of California in the United States. Automation Anywhere makes no representation that the Sites or the Content are accessible or appropriate or available for use in other locations. Those who choose to access the Sites from other locations do so on their own initiative and are responsible for compliance with applicable local laws. 14.3 Governing Law and Jurisdiction. These Terms and any dispute or claim arising out of or related to these Terms, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of or related to these Terms or the Sites (including the Content) shall be instituted exclusively in the federal or state courts located in Santa Clara County, California.
