“ to the extent that the Infringement Claim is attributable to or results from: (i) a modification to the AI21 System or AI21 Model not made by AI21; (ii) the combination of the AI21 System or AI21 Model with any non-AI21 product or service; (iii) any Customer instructions or specifications; (iv) any Customer breach under this Agreement; (v) any Inputs or Outputs; and/or (vi) any failure by Customer to use the most current version of the AI21 System or AI21 Model made available by AI21 to Customer pursuant to this Agreement;”
