LANDR policy evolution

“For clarity, mere registration or membership with a PRO, CMO, or NRO does not by itself make a recording ineligible, provided you retain the right to grant LANDR a direct license to that recording without requiring the approval of, or any additional payment to, that entity. If you are signed to a publisher or a label, or your recording is subject to an exclusive grant in favor of a collecting society, the recordings subject to those arrangements will not be eligible to be Qualifying Recordings. If you opt-in to the Fair Trade AI Program you grant us a non-exclusive, transferable, sublicensable right that, with respect to any AI model trained on your Qualifying Recordings before your opt-out takes effect, is irrevocable (see Opting Out limitations below), and that is otherwise revocable as to future Datasets and future model training and license throughout the World to use the Qualifying Recordings and authorize our collaborators and sub-licensees (our "AI Collaborators") to use the Qualifying Recordings to develop and offer AI Products, including the right to: a) reproduce, convert, store, use and modify, make derivative works, alter and remix the Qualifying Recordings for machine learning, training, improving, modifying, validating, testing and evaluating neural networks in order to build AI models based either in whole, or in part, on the Qualifying Recordings; and b) create, and allow users to create through such AI Models Outputs that may be used for commercial exploitation; c) use the Qualifying Recordings for: i) research and development relating to AI applications; and ii) for internal business purposes related to the development of AI systems and AI Products.”

“Opting back in: If you have successfully opted out previously, you may rejoin the Fair Trade AI Program at any time from your AI settings page. Rejoining is treated as a new opt-in: the license grant above takes effect as of the date you rejoin, and your Qualifying Recordings will be considered for inclusion in Datasets beginning with the next scheduled Dataset update following your re-enrollment. Rejoining does not restore your Qualifying Recordings to any Dataset delivered, or to any AI model trained, during any period in which you were opted out. Your participation upon rejoining will be governed by the terms of this Agreement as in effect at the time you rejoin, including the then-current revenue share percentage. Re-enrollment does not entitle you to any new Upfront Recoupable Advance Payment, which remains by selection and acceptance only. We reserve the right to decline or limit re-enrollment where we reasonably believe repeated opt-in and opt-out activity is intended to manipulate the Program or its payment structure.”

“Your music is yours. This means that you keep the ownership of all your intellectual property rights in the Recording of your musical work that uses any Sample, but please take note that this doesn’t mean you own any rights on any Sample, even when they are incorporated in your Recordings.”

“We reserve the right to remove certain Qualifying Recordings from the Fair Trade AI Program should we suspect that the eligibility criteria have not been complied with, or if the quality of the files is not adequate and for any other reason where removal would be deemed necessary in our reasonable opinion. We further reserve the right to decide in which Datasets we will include your Qualifying Recordings, so not all available AI Products created from AI models will be using your Qualifying Recordings. Finally, we shall be entitled to correct any metadata related to the Qualifying Recordings. Any ownership of the Qualifying Recordings shall remain solely with you and we shall be entitled to use them within the limits of the license set out in these terms. The AI models used as part of the Fair Trade AI Program may generate certain sound recordings, which may include full length tracks, samples, one shots, single hits, beats, loops, stems and similar items (and any compositions and/or lyrics embodied therein) created using AI models (the "Outputs"). You make no claim whatsoever regarding any ownership of the Outputs as well as any AI models and related data and files including any AI Products. For clarity, any and all rights, title and interest in and to such AI model, AI Products, and any related data and files, including any Outputs shall remain with us or our AI Collaborators as the case may be and subject to any legislative development as to the copyrightability of such Outputs.”
