“ To the fullest extent permitted by law, Vidu and its affiliates, licensors, officers, directors, employees, and agents (“Vidu Parties”) are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising from your use or inability to use the Services; third-party conduct or content on the Services; any content obtained from the Services; or unauthorized access to your transmissions or content. In no event shall Vidu Parties’ total liability exceed the greater of $100 or the amount you paid Vidu in the past 12 months for the relevant Services. These limitations apply regardless of the legal theory, even if a remedy fails its essential purpose.”
