“That telemetry contains no and is not derived from Customer Data, Outputs, or substantive content from your Inputs. We never use telemetry to train a model. Where Customer Data includes personal data, you are the controller (or, under United States state privacy laws, the business) and we act as your processor (or service provider). We process personal data only on your documented instructions, which these Terms of Service and your configuration of the Cloud Service constitute, and we do not sell or share personal data or retain, use or disclose it for any purpose other than performing the Cloud Service for you. Our data processing addendum, available at www.tracecat.com/dpa , applies to that processing, forms part of these Terms of Service and takes effect when you accept these Terms of Service, with no separate signature required. If you and Tracecat sign a separate data processing agreement covering the Cloud Service, that agreement applies instead. Where the Cloud Service offers a choice of hosting region, we store Customer Data in the region you select, and our support access, logging and ancillary processing of Customer Data also stay in that region. We maintain administrative, technical and physical safeguards designed to protect Customer Data against unauthorized access, loss or disclosure. Information about our security controls is available at trust.tracecat.com . You may export Customer Data from the Cloud Service at any time while your Account is active, and for thirty (30) days after your free trial or Account ends. ”
