“ 11. ADDITIONAL TERMS. These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. You expressly agree that the exclusive jurisdiction for any claim or dispute under these Terms resides in the courts located in Seattle, Washington, and you further expressly agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such claim or action. Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. The waiver of any breach of these Terms will be effective only if in writing, and no such waiver will operate or be construed as a waiver of any subsequent breach. If any provision of these Terms is held to be unenforceable, then that provision is to be construed either by modifying it to the minimum extent necessary to make it enforceable (if permitted by law) or disregarding it (if not permitted by law), and the rest of these Terms are to remain in effect as written.”
