“ Hedge's liability for any claim arising out of our wholesale brokerage services is subject to our professional errors and omissions coverage and the applicable terms of our broker agreement with the retail agency. In no event will Hedge be liable for indirect, consequential, or punitive damages. Nothing in these terms limits liability for fraud, gross negligence, or willful misconduct. Nor should any limitation be read to violate applicable state insurance regulation.”
