“TO THE FULLEST EXTENT PROVIDED BY LAW, GAMMA PARTIES WILL NOT BE LIABLE TO YOU FOR MORE THAN THE GREATER OF (a) THE TOTAL AMOUNT PAID TO GAMMA BY YOU DURING THE ONE-MONTH PERIOD PRIOR TO THE ACT, OMISSION OR OCCURRENCE GIVING RISE TO SUCH LIABILITY; (b) $100; OR (c) THE REMEDY OR PENALTY IMPOSED BY THE STATUTE UNDER WHICH SUCH CLAIM ARISES. THE FOREGOING CAP ON LIABILITY SHALL NOT APPLY TO LIABILITY OF A GAMMA PARTY FOR (i) DEATH OR PERSONAL INJURY CAUSED BY A GAMMA PARTY'S NEGLIGENCE; OR FOR (ii) ANY INJURY CAUSED BY A GAMMA PARTY'S FRAUD OR FRAUDULENT MISREPRESENTATION.”
