“ “ Personnel ” means a person’s employees, agents, consultants or contractors. “ Process ” and inflection thereof means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. “ Processor ” means the entity that Processes Personal Data on behalf of the Controller, including, as applicable, any “service provider” as that term is defined by the CCPA. “ Restricted Transfer ” means the disclosure, grant of access or other transfer of Customer Personal Data to any person located in: (i) in the context of the EEA, any country or territory outside the EEA which does not benefit from an adequacy decision from the European Commission (an “ EU Restricted Transfer ”); and (ii) in the context of the UK, any country or territory outside the UK, which does not benefit from an adequacy decision from the UK Government (a “ UK Restricted Transfer ”), which would be prohibited without a legal basis under Chapter V of the GDPR. “ SCCs ” means the standard contractual clauses approved by the European Commission pursuant to implementing Decision (EU) 2021/914. “ Service Data ” means any data relating to the use, support and/or operation of the Services, which is collected directly by Baseten from and/or about users of the Services and/or Customer’s use of the Service for use for its own purposes (certain of which may constitute Personal Data). ”
