“ The DPA applies only applies to Baseten’s Processing of Customer Personal Data under the Agreement to the extent such Customer Personal Data is subject to Applicable Data Protection Laws. Annex 2 (European Annex) to this DPA applies only if and to the extent Baseten’s Processing of Customer Personal Data under the Agreement is subject to the GDPR. Annex 3 (California Annex) to this DPA applies only if and to the extent Baseten’s Processing of Customer Personal Data under the Agreement is subject to the CCPA with respect to which Customer is a “business” (as defined in the CCPA).”
