“ 12.1 Binding Arbitration. Any disputes arising out of or related to these Terms or the Services will be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association. 12.2 Class Action Waiver. YOU AND AMINOANALYTICA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. 12.3 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.”
