The foregoing obligations do not apply if: (v) the Customer Claim arises from Software or any part thereof that is modified by Customer, or at Customer’s direction, after delivery by Activepieces; (w) the Customer Claim arises from the use or combination of the Software or any part thereof with other products, processes or materials not provided by Activepieces where the alleged infringement relates to such combination; (x) Customer continues allegedly infringing activity after being notified thereof or after being informed of modifications that would have avoided the alleged infringement; (y) the Customer Claim arises from software not created by Activepieces, or (z) the Customer Claim results from Customer’s breach of this Agreement and/or applicable Order Forms.
